No, it can just include payouts in the block directly. Using CTV to commit to the payouts only defers the time at which the payout transaction hits the chain, at the cost of more block space usage. It is not a scalability solution.

Sure, it’s not guaranteed but at least is not literally proposing to use more block space as a scalability solution.

I am aware of the arguments for CTV-based congestion control. I was just pointing out that OP is merely proposing to use congestion control for mining pool payouts, and that it is incorrect to claim this is a scalability solution.
